Jakarta (B2B) - Mahkamah Konstitusi menyatakan KPU telah melakukan pelanggaran karena membuka kotak suara di luar perintah pengadilan.

"Termohon (KPU) membuka secara bebas kotak suara, meskipun termohon wajib menyimpan dan memelihara, namun termohon membuka kotak suara harus menindahkan norma yang berlaku, secara itu merupakan pelanggaran," kata Hakim Konstitusi Anwar Usman saat membacakan pertimbangan hukum Putusan Perselisihan Hasil Pemilihan Umum Presiden dan Wakil Presiden (Sengketa Pilpres) di Jakarta, Kamis.

Namun, lanjut Anwar, hal tersebut tidak terkait dengan perolehan suara, maka mahkamah tidak berwenang mengadilinya.

"Jika masalah etik DKPP yang mengadili. jika pembukaan kotak sura tersebut merupakan ranah hukum pidana, jadi instansi lain yang mengadilinya," katanya.

Walaupun hal tersebut merupakan pelanggaran, kata Anwar, namun pembukaan kotak untuk mencari bukti dan bisa dipertanggungjawabkan maka pengambilan bukti itu dianggap sah.

"Perolehan bukti demiakan (membuka kotak suara), menurut mahakamh berdasarkan surat permohonan dan secara umum dilaksanakan mengundan panwaslu, saksi bahkan polisi serta berita acara, perolehan bukti ini sejalan dengan ketetapana mahkamah," kata Anwar.

Pembukaan kotak suara ini dipermasalahkan pemohon (pasangan calon presiden dan wakil presiden Prabowo Subianto-Hatta Rajasa).

Pihak pemohon menilai KPU telah merusak alat bukti karena membuka kotak suara dengan mengeluarkan Surat Edaran (SE) KPU Nomor 1446 pada 25 Juli 2014.

Permohonan sengketa Pilpres ini diajukan oleh pasangan calon presiden dan wakil presiden Prabowo Subianto-Hatta Rajasa.

Prabowo-Hatta mengajukan gugatan atas dugaan adanya kecurangan yang terstruktur, sistematis, dan masif pada pelaksanaan Pilpres 2014.

Pembacaan putusan sengketa Pilpres hingga berita ini diturunkan masih berlangsung.

Jakarta (B2B) - The Indonesian Constitutional Court (MK) gave a ruling that the Indonesia General Elections Commission (KPU) had committed violation by opening the disputed ballot boxes beyond the order of the court.

"The petitionee (KPU) unilaterally opened the ballot boxes despite the fact that it has an obligation to keep and maintain them. In opening the boxes, it should have observed the existing norms. Therefore, it has committed a violation," MK Judge Anwar Usman stated while reading out the courts legal consideration in the presidential election result dispute case here on Thursday.

However, Anwar pointed out that the matter does not concern voter turnout, so it is beyond MKs jurisdiction.

"If it is an ethics issue, it will come under the authority of the Election Organizers Ethics Council (DKPP) to deal with it in court," he emphasized.

He stressed that although opening of the ballot boxes for finding credible pieces of evidence is a violation, however, taking the evidence was considered legal.

"Attaining pieces of evidence (opening boxes) according to the MK based on a request and on the basis of inviting the Election Supervisory Committee (Panwaslu) and witnesses from the police is in line with MKs decision," he added.

The opening of the ballot boxes is disputed by the petitioner (the Presidential and Vice Presidential Candidate Prabowo-Hatta pair).

The petitioner is of the view that the KPU has tampered with the evidence by opening the boxes and by releasing a KPU circular No. 1446 on July 25, 2015.

The Prabowo-Hatta duo has filed a dispute on the presidential election results with the MK alleging structured, systematic, and massive election fraud during the implementation of the 2014 presidential election.
