Jakarta (B2B) - Indar Atmanto, mantan Direktur Utama PT Indosat Mega Media (IM2) dituntut pidana penjara selama 10 tahun dan denda Rp500 juta. Jaksa Penuntut Umum Fadil Zumhana juga meminta majelis hakim mewajibkan PT Indosat dan PT IM2 untuk ganti rugi bagi negara Rp1,358 triliun akibat perjanjian yang dibuat Indar Atmanto bersama Indosat.
JPU Fadil Zumhana mendakwa Indar Atmanto terbukti melakukan korupsi dalam penggunaan frekuensi 3G milik Indosat. Terdakwa terbukti bersalah melanggar Pasal Pasal 2 ayat 1 juncto Pasal 18 ayat 1 Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi sebagaimana telah diubah dengan Undang-Undang Nomor 20 Tahun 2011 juncto Pasal 55 ayat 1 ke-1 KUHP.
"Hal-hal yang memberatkan terdakwa, karena tidak mengakui perbuatannya padahal perbuatannya mengakibatkan kerugian negara yang cukup besar. Sedangkan yang meringankan, dia tak pernah dihukum serta bersikap santun di persidangan," kata JPU Fadil Zumhana di Pengadilan Tindak Pidana Korupsi Jakarta, Kamis (30/5).
Jaksa menguraikan, korupsi ini bermula saat Indar Atmanto menandatangani kerja sama dengan Johnny Swandi Sjam yang saat itu menjadi Wakil Direktur Indosat pada 24 November 2006. Inti perjanjian itu Indosat dan IM2 sepakat bekerja sama dalam pekerjaan akses broadband jaringan 3G.
Indosat bertanggung jawab menyediakan modem, sedangkan IM2 melakukan pemasaran, penagihan, dan costumer support. Perjanjian ini terus dilanjutkan oleh Dirut Indosat periode 2007-2009 Johnny Swandi Sjam dan Dirut Indosat periode 2009-2012 Harry Sasongko.
Perjanjian itu, kata jaksa, seolah-olah merupakan kesepakatan penggunaan jaringan, padahal secara operasional bertujuan memberikan akses kepada IM2 untuk menggunakan spektrum Indosat. Hal ini diduga untuk menghindari agar IM2 tak perlu membayar kewajiban Biaya Hak Penggunaan (BHP) spektrum. Soalnya, dari hasil pengujian di lapangan, IM2 menggunakan frekuensi 3G milik Indosat. Padahal, berdasarkan peraturan pemerintah, pemegang alokasi frekuensi radio tak dapat mengalihkan frekuensi yang diperolehnya kepada pihak lain.
"Dengan demikian, IM2 telah menggunakan frekuensi 3G Indosat secara tanpa hak. Unsur melawan hukum telah terbukti secara sah dan meyakinkan menurut hukum," kata jaksa Fadil.
Kerja sama ini membuat IM2 tak membayar up front fee dan BHP sehingga membuat IM2 dan Indosat mendapat keuntungan dengan total Rp 1,483 triliun. Lantaran tak membayar, IM2 juga disebut membuat negara dirugikan Rp 1,358 triliun. Nilai ini merupakan jumlah up front fee yang mestinya dibayar di muka dan BHP tahunan sejak 2006.
Indar dan tim penasehat hukumnya menyatakan akan mengajukan nota pembelaan atau pledoi atas tuntutan ini. "Kami akan mengajukan pembelaan," katanya.
